Federal judge holds that TX’s anti-SLAPP law applies in federal court

Laura Lee Prather, PPP Board member and partner at Haynes and Boone, LLP, was the lead attorney for defendants in Williams v. Cordillera Communications, Inc., a defamation suit brought in the Southern District of Texas. Prather told PPP that the case “is significant because it is the first square application of the Texas anti-SLAPP statute in federal court.” The case presented a head on challenge to the applicability of the Texas anti-SLAPP statute in federal court as conflicting with Federal Rules of Civil Procedure 12 and 56. However, The district court judge that the anti-SLAPP statute was more substantive than procedural and should thus apply in federal court.
